Can you have an HSA if one of their children a secondary insurance?
We have a secondary insurance for my way to a child by a recent court order. His mother has set up an HSA at 1.7 and is using the secondary coverage for the child. Is it against the law to have an HSA when you have a secondary medical coverage available for a child? I could not have both high coverage and an HSA, but since it is a child and not the account holder that does not apply the rule?
Any adult can contribute to an HSA if they: • Have coverage for a HSA-qualified "health plan deductible high" (HDHP) • Have no other first dollar medical coverage (other types of insurance like specific injury insurance or accident, disability, dental care, vision care, or long-term care insurance are permitted). • Is not enrolled in Medicare. • Can not be claimed as a dependent on someone else's return taxes. On this basis I agree with your thinking that she can not have secondary coverage unless specific injury insurance or accident, disability, dental care, vision care, or insurance long term care
