Officers Life Insurance Deductible
Can you compel the prosecution to pursue a criminal case where I am a victim?
A person who destroyed my new car, extensively. Certain cover the cost (excluding $ 500 deductible). The person who has admitted he did. .. for me and some mutual friends. I have a statement affidavit from a friend that mentioned the confession. The police officer says is a felony and has referred the case to DA. For some reason, the prosecutor is not interested in investigate. I want the case pursued because that person has made my life hell (even has a restraining order against him). How can I convince a / force the DA to prosecute this case?
Ever wonder why the prosecutor does not pursue the case? There may be a good reason. Not all cases can be prosecuted. Sometimes the evidence is not as strong as you might think. In addition, a third-party confession is generally considered hearsay and would be inadmissible. If he takes the position and says he did not, these witnesses of his confession could be hired to refute the testimony of the accused, but usually is not direct evidence of guilt. Call the DA and ask. It is better to know rather than guess. He can only be waiting for more police monitoring. – Carl
