What if the tenants don’t move out of the house I bought?
I bought my first house and it closes June 30 (60 day closing). It was a rental property and will be my primary residence (I will not have tenants). The seller and me signed an amendment to the offer stating the the house will be unoccupied when I take possession (there is a new law in Canada affecting rental properties and mortgage insurance). So the seller is the person that is supposed to evict the current tenants. I drove by the other day and the tenants are still in the house and now they have their lawn furniture out.
I’m worried that the tenants will not leave by the time I take possession. What do I do if they don’t? Where am I supposed to live until the leave?
The tenants are not on a year lease, they only require 60 days notice.
Do a walk through of the house the day before the closing and if they are not out, delay the closing. If the amendment is done correctly that should be a legitimate reason for you to postpone it. I would tell your real estate agent that you plan to do that so that they can relay the information to the seller.
